SERVICE CONNECTIONS HR CONSULTANCY DATA PROTECTION POLICY

  1. INTRODUCTION
    1. Service Connections HR Consultancy Pte Ltd (the “Company”, “we”, “us”, “our”) respects your privacy and we acknowledge that you have certain rights related to any personal data we collect from you and we have certain obligations in respect of the same. The Company is compliant with certain local privacy laws, including the Singapore Personal Data Protection Act 2012 (“PDPA”) and its related laws, and has procedures in place to meet the requirements of those laws.
    2. This Privacy Policy (“Privacy Policy”) outlines our principles and practices regarding the collection, storage, use, and disclosure of your personal data. We encourage you to review this policy to understand how we may gather, process, utilize, disclose, and share your personal information.
    3. For clarity, “personal data” refers to any information, whether accurate or not, that identifies an individual either, directly from that data, or, in combination with the data provided and with other information that the organisation has or is likely to have access to the availability of data.
  2. INFORMATION WE COLLECT, USE OR DISCLOSE
    1. Delivering our services and operating our business effectively—such as recruiting and placing individuals for potential work assignments, acting as an employer or hirer of record, and providing human resources-related services to our customers—requires us to collect specific personal data from candidates, employees, contractors, and former employees. Without obtaining the necessary personal data, we may be unable to proceed with these services, including offering potential job placements to the individuals concerned.
    2. The categories of personal data that we collect, use, process, disclose, and store are determined by the specific circumstances and the legitimate purposes for which such processing is required, in compliance with applicable laws and regulations. Therefore, in accordance with the above, the personal data in question may include:
      • Name;
      • Contact information (address, phone number, e-mail address);
      • Employee identification number;
      • Date of birth;
      • Other identification provided to the Company for application or employment purposes;
      • Academic background and work experience;
      • Professional expertise and experience;
      • Professional qualifications or certifications;
      • Membership / Affiliation in professional organisations / associations;
      • Additional details included in an individual’s Resume /Curriculum Vitae (CV);
      • Nationality and employment eligibility status;
      • Medical conditions and accessibility needs;
      • Emergency contact details or next-of-kin information;
      • Data from and related to openly available job-related profiles you have created.
      • Employment platforms (e.g., LinkedIn, MyCareersFuture, Indeed, etc.) and social media platforms;
      • Data furnished by references; and
      • Insights into your career aspirations, preferences, and qualifications.
    3. Additionally, in accordance with applicable laws and under specific circumstances, we may request certain types of personal data that are classified as “sensitive” in some countries.
      • National and/or tax identification number, social security number(s) if applicable or passport identification number;
      • Financial details or banking information;
      • Results of drug tests, criminal records, and background checks;
      • Benefit selections, which may include details on health insurance and retirement planning;
      • Biometric data;
      • Records in your personnel file with the company, such as performance assessments, disciplinary action/s, and payroll-related information; and
      • Health/Medical information, including those associated with a work-related case (e.g., workers’ compensation case)
    4. In certain legal domain, to conform with applicable laws, rules, and standards in relation to equal and fair employment opportunities or to support the Company and its affiliated entities in gathering data for non-discriminatory policies and reporting, we may request information regarding gender, race/ethnicity, or disability status. Providing this information is voluntary unless mandated by law, and failure to do so will not impact your employment or project opportunities.
    5. Your interactions with our websites and mobile applications may also result in the collection, processing, and storage of the following types of information from you: Your engagements with our websites and / or with our mobile applications may lead to the compilation, handling, and retention of the following categories of information:
      • Geolocation data; and
      • Any additional information you choose to provide to us, including through feedbacks, engagements with our social media platforms, or other channels used to communicate with the Company.
    6. Certain websites may ask for your personal information when setting up a profile and login details. Rather than manually entering this data, some functionalities may enable you to use third-party authentication services like Facebook, Twitter, or Google to automatically fill in specific fields. Certain websites may require you to provide personal data, such as when creating a profile and log-in credentials. To streamline this process, some functionalities may allow you to use third-party authentication tools, such as Facebook, Twitter, or Google, to autofill specific fields. By opting for authentication through a social media platform, you grant us access to your personal data and other information available through these tools, which may be incorporated into your profile. We strongly recommend reviewing the privacy policies and terms of service of the respective third-party providers before using these authentication options
    7. We may process your personal information to enable you to participate in live social media streams. If you choose to take part, your public username, along with content you share, including, but not limited to, comments, images, and videos, may appear on the websites.
    8. We may provide you with access to third-party functionality that allows you to post content to your social media account(s). Any information you provide to your social media account(s) through such third-party functionality is governed by the third party’s privacy policy, not this Privacy Policy. For clarity, we are not responsible for any personal data you provide to such third party.
  3. The Purposes for Which We Collect, Use and Disclose Your Personal Data
    1. We will/may collect, use, disclose and/or process your personal data for one or more of the following purposes:
      1. Overseeing, executing, and/or managing any transactions between you and the Company and/or its related entities, including, but not limited to, your application for employment or work with the Company;
      2. Hiring, evaluating, and/or connecting you with potential positions or assignments with third-party organisations (or our customers), as well as handling related matters, such as offering you a job placement with such organisations or referring you for employment opportunities with a third-party organisation (or our customer);
      3. administering, managing, and/or facilitating the provision of work or job placement services to you. This includes sharing your personal data with our customers or third-party organizations for potential placement or employment opportunities, or with the organization to which you have been assigned to work, in cases where those customers or organizations are seeking employees or workers;
      4. executing your instructions or responding to any inquiries made by you, purportedly made by you, or made on your behalf;
      5. Managing, facilitating, processing, or handling matters connected to your use of the Company’s or its affiliates’ websites, any features or functionalities on those websites, and any transactions or activities you conduct on or through them, including, but not limited to, live social media feeds.
      6. Observing, managing, and tracking your interactions with the Company’s or its affiliated entities’ websites to ensure a smooth user experience, support or oversee your usage of these platforms, and help enhance your overall experience while navigating them.
      7. Reaching out to you or communicating with you through phone/voice calls, text messages, faxes, emails, or postal mail to manage your use of the Company’s or its affiliates’ websites, process any transactions with us, or provide you with our services. You acknowledge and agree that such communication may include sending letters, documents, or notices, which may require the disclosure of certain personal data to ensure delivery, including on the external packaging of mail.
      8. Conducting due diligence or other verification processes, including background checks, in compliance with applicable legal or regulatory requirements (whether from Singapore or any other jurisdiction), as well as adhering to guidelines set by relevant governmental authorities or our own risk management protocols, whether mandated by law or established by our organization.
      9. To deter or probe fraud, unlawful activities, omissions, or misconduct, regardless of whether suspicion of such activities exists; to manage conflicts of interest; and to handle and/or investigate complaints;
      10. Managing internal operations, including conducting data analytics to improve and enhance systems, processes, and human resources functions;
      11. Adhering to any applicable laws, governmental or regulatory requirements in any jurisdiction that apply to us or our affiliates, including fulfilling disclosure obligations under laws that bind us or our affiliates, and/or complying with guidelines set by regulatory or other authorities (whether in Singapore or another country) that we or our affiliates are obligated to follow.
      12. Complying with, or as required by, any request or directive from a governmental authority (whether in Singapore or outside Singapore) that we are expected to adhere to, or responding to information requests from public agencies, ministries, statutory boards, or other relevant authorities. For clarity, this includes disclosing your personal data to the aforementioned entities upon their request or direction;
      13. Storing, hosting, and backing up your personal data, whether for disaster recovery or other purposes, in locations within or outside Singapore;
      14. Facilitating, managing, and/or administering external and internal audits of the Company’s business and/or its related corporations;
      15. for marketing purposes, provided that you have separately given your consent. If consent is given, we may send your marketing and promotional information and materials via email, postal mail, or other communication channels regarding products and/or services offered by the Company or its related corporations, including those from third-party organisations with whom the Company collaborates or partners. These products and services may be existing or developed in the future. For marketing and promotional communications sent via voice calls or instant messaging applications such as SMS/MMS, WhatsApp, or Telegram to your Singapore telephone number, we will only do so in compliance with the requirements of the Personal Data Protection Act (PDPA) or where you have expressly consented to receiving such communications through these channels; and
      16. managing and/or facilitating a business asset transaction or a potential business asset transaction involving the Company as a participant, which may also include other third-party organisations. A “business asset transaction” refers to the purchase, sale, lease, merger, amalgamation, or any other form of acquisition, disposal, or financing of an organisation, a portion of an organisation, or any of its business or assets. (Collectively, the purposes outlined above shall be referred to as the “Purposes.”)
    2. The Company may / will be required to disclose your personal data to third parties, whether within or outside Singapore, for one or more of the aforementioned Purposes, as these third parties may process your personal data in alignment with these Purposes. By providing your personal data, you acknowledge, agree, and consent to the Company disclosing your personal data to such third parties (whether within or outside Singapore) for one or more of the stated Purposes, and to these third parties subsequently collecting, using, disclosing, and/or processing your personal data accordingly. Without limiting the general scope of the above statement or the preceding paragraph outlining the Purposes, such third parties may include:
      1. our associated or affiliated organisations, as well as related corporations.
      2. any of our agents, contractors, or third-party service providers that process or will process your personal data on our behalf, including but not limited to those providing administrative or other support services such as mailing houses, telecommunications companies, information technology service providers, and data centers;
      3. Our customers or third-party organisations that may serve as your potential employers, hirers, or entities engaging your services; and
      4. third parties to whom the Company discloses your personal data for one or more of the stated Purposes, and who, in turn, will collect and process your personal data in alignment with those Purposes.
    3. Your consent under this Privacy Policy is supplementary and does not replace any other consents you have previously provided to the Company regarding the processing of your personal data. We may also collect, disclose, or use your personal data under exceptions permitted by the Personal Data Protection Act or other applicable laws, including but not limited to the following situations:
      • To respond to an emergency that poses a threat to your life, health, or safety, or that of another individual; and
      • Necessary in the national interest, for any investigation or proceedings.
    4. Information that has been de-identified does not reveal your personal identity and is therefore not subject to this Privacy Policy.
    5. We hold our employees, agents, and suppliers accountable for safeguarding the trust you place in us with your personal data. Your personal data will only be used or shared in compliance with applicable laws governing personal data protection.
    6. Your personal data may be shared with third-party service providers as outlined in paragraph 3.2 above.
    7. In line with paragraph 3.2 above, due to the scope of the Company’s operations, sharing your personal data with our group entities, service providers, and customers may result in your data being transferred to countries outside your country of residence. These countries may have data protection laws that differ from those in your jurisdiction. Regardless of where your personal data is collected or transferred, we will always protect it as outlined in this Privacy Policy and ensure compliance with applicable data protection laws when processing or transferring your personal data.

    1. The Company’s websites utilize “cookies” to enhance and personalize your online experience. A cookie is a small data file stored on your computer or mobile device that is linked to information about you. These cookies also enable us to recognise your device when you revisit our website. You can configure your browser settings to alert you before a cookie is received, allowing you to choose whether to accept it. Additionally, you can disable cookies entirely through your browser settings; however, this may cause certain parts of our websites to function improperly. We utilize both session ID cookies and persistent cookies. A session ID cookie automatically expires when the user closes their browser.   5. Your Rights and Choices
    1. The personal data you provide when requesting our services will only include what is essential and relevant for delivering those services or for the specific purposes for which the data is being collected.
    2. If you have requested or explicitly permitted us to do so, we may occasionally use your contact details to send you email updates about marketing materials, promotional content, or services related to your interactions with us, such as job opportunities that match your specified preferences. Each email will include instructions on how to unsubscribe from future communications from the respective service or resource. When we collect your personal information, our website also allows you to select the types of communications you wish to receive. If you choose to opt out, your preferences will be automatically updated in our database. However, if you have registered for multiple services or resources, you may need to unsubscribe from each one individually.
    3. Additionally, you have the right to request access to your personal data, withdraw your consent for its use and processing, and request corrections to any inaccuracies in the personal data maintained by the Company or under its possession or control. However, we may limit or deny such requests or impose reasonable fees for access, in compliance with applicable data protection laws.
    4. When you request access to or correction of the personal data in our possession or control, we will require sufficient information to verify your identity and understand the nature of your request to process it appropriately.
    5. For a request to access personal data, once we have obtained sufficient information from you to process the request, we will seek to provide the relevant personal data within 30 days. If we are unable to respond within this timeframe, we will inform you of the earliest possible date by which we can provide the requested information. Please note that certain types of personal data are exempt from access requests under the Personal Data Protection Act (PDPA).
    6. For a request to amend personal data, once we have sufficient information from you to deal with the request, we will correct your personal data within 30 days. If we are unable to complete the correction within this timeframe, we will inform you of the earliest possible date by which it can be done. Please note that under the PDPA, certain types of personal data are exempt from your correction request, as well as provides for situation(s) when correction need not be made by us despite your request.
    7. We will process your request to withdraw your consent within a reasonable time from such a request being made, and will thereafter not collect, use and/or disclose your personal data in the manner stated in your request. However, your withdrawal of consent could result in certain legal consequences arising from such withdrawal. In this regard, depending on the extent of your withdrawal of consent for us to process your personal data, it may mean that we will not be able to continue providing our services such as recruitment, placement, or employment, as the case may be.
  6. Administration, Management, Protecting and Retaining Your Information
    1. We will make reasonable efforts to ensure that your personal data is accurate and complete, particularly if it is likely to be used by the Company to make a decision affecting you or disclosed to another organisation. However, it is your responsibility to inform us of any changes to the personal data you originally provided. We will not be liable for any consequences arising from our reliance on inaccurate or incomplete personal data due to your failure to update us.
    2. We will implement reasonable and appropriate administrative, physical, and technical safeguards to protect your personal data. These measures include up-to-date antivirus protection, encryption, privacy filters, access controls, password protection, and restricting the disclosure of personal data—both internally and to authorized third-party service providers and agents—on a need-to-know basis. These precautions aim to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal, leakage, loss, damage, and/or alteration of your personal data. However, we cannot be held responsible for any unauthorized use of your personal data by third parties when such incidents are wholly attributable to factors beyond our control.
    3. You should be aware that no method of transmission over the Internet or electronic storage is entirely secure. While we cannot guarantee absolute security, we are committed to safeguarding your information and continuously reviewing and enhancing our security measures to protect your personal data.
    4. We will implement measures to ensure that your personal data in our possession or under our control is securely destroyed and/or anonymized once it is reasonable to assume that:
      1. The purpose for which the personal data was collected is no longer being served by its retention; and
      2. Retention is no longer required for any legal or business purposes.
    5. If your personal data is transferred outside of Singapore, we will ensure compliance with the PDPA. This includes taking necessary measures to confirm that the receiving organization abroad is subject to legally enforceable obligations, ensuring a level of protection for the transferred data that is at least equivalent to the standards outlined in the Act. This may involve establishing an appropriate agreement with the foreign recipient to govern the data transfer or, where permitted by the PDPA or applicable laws, proceeding without such an agreement
  7. Data Breach Notification
    1. In the event of a security breach resulting in the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data, we will promptly assess its impact. If the breach is determined to be a notifiable data breach, we will report it to the Personal Data Protection Commission (PDPC) within three (3) calendar days. If the breach is likely to cause significant harm to you, we will notify you after our report to the PDPC. Additionally, we may also inform other relevant regulatory authorities, where required.
    2. If we act as a Data Intermediary, we will promptly notify the relevant Data Controller of any data breach, enabling them to assess its impact and fulfil their data breach notification obligations in accordance with applicable laws and regulations.
